oasis fit policies

These Oasis Fit policies (“Policies”) apply to all the members and guests of AIT Business Services LLC d/b/a Oasis Fit (“Oasis Fit”). They govern your use of the Oasis Fit facility (the “Facility”) as well as Oasis Fit services, including, but not limited to, spa services, biocell-related services, and fitness classes (“Services”). These policies are meant to ensure an exceptional experience for all members, so please read them carefully and note that Oasis Fit may, without limitation, remove you from the Facility, suspend your membership, or terminate your membership for any violation of these Policies. 

1. entry

 

  1. Check-In. You must check-in each time you enter the Facility, even if you exit the Facility only briefly. You may check-in by presenting your current membership card or any other method authorized by Oasis Fit. Oasis Fit may require you to verify your identity before entering the Facility by asking you to present photo identification. 
  2. Variable Hours. You acknowledge that the Facility may close or operate at reduced hours on holidays, weekends, or for maintenance. Oasis Fit business hours, policies, and regulations are subject to change without notice. 
  3. Overdue Accounts. Oasis Fit may prohibit your entry to the Facility and/or Services if your membership dues are unpaid or if you violate any of the Policies. 
  4. Freezes. You will not be permitted to enter or use the Facility during any period your membership is frozen pursuant to these Policies. 
  5. Children. Children are permitted entry only under the conditions listed in section 5 below. 

2. memberships

  1. IN CONSIDERATION FOR THE SERVICES PROVIDED UNDER THIS AGREEMENT, YOU WILL PAY A ONE-TIME NON-REFUNDABLE REGISTRATION FEE OF $100. THIS FEE WILL BE CHARGED UPON THE INITIAL REGISTRATION AND WILL NOT BE CHARGED AGAIN UPON ANY RENEWAL OF THE MEMBERSHIP. 

  2. YOUR MONTHLY MEMBERSHIP FEE WILL BE BILLED TO THE ABOVE ACCOUNT IN THE BILLING CYCLE OF EACH CALENDAR MONTH FOR <RECURRINGPAYMENT> PER MONTH UNTIL YOU CANCEL IN ACCORDANCE WITH THIS AGREEMENT. 

  3. MEMBERSHIPs HAve A SIX-MONTH INITIAL TERM AND WILL AUTOMATICALLY RENEW FOR CONSECUTIVE SIX-MONTH TERMS (EACH, A “RENEWAL TERM”, AND COLLECTIVELY, THE “RENEWAL TERMS”) UNTIL YOU CANCEL IN ACCORDANCE WITH THIS AGREEMENT. NOTE THAT OASIS FIT RESERVES THE RIGHT TO INCREASE YOUR MONTHLY MEMBERSHIP FEE IN ADVANCE OF ANY RENEWAL TERM.
  4. TO CANCEL YOUR MONTHLY MEMBERSHIP AND STOP THE BILLING OF THE MONTHLY MEMBERSHIP FEE, YOU MUST DELIVER WRITTEN NOTICE TO OASIS FIT THIRTY (30) DAYS BEFORE YOUR NEXT BILLING DATE. PLEASE NOTE IT CAN TAKE UP TO SEVEN (7) BUSINESS DAYS FOR ANY MEMBERSHIP OR BILLING CHANGES TO TAKE EFFECT. 

  5. IF YOUR MONTHLY MEMBERSHIP HAS A MINIMUM TERM, AND YOU WISH TO CANCEL YOUR MEMBERSHIP BEFORE THE END OF THE TERM FOR REASONS OTHER THAN THOSE EXPRESSLY SET FORTH IN THIS AGREEMENT, A $100 cancellation FEE IS REQUIRED. 

  6. IF YOUR CREDIT OR DEBIT CARD EXPIRES, YOU AUTHORIZE US TO OBTAIN A NEW EXPIRATION DATE FROM THE CARD ISSUER, IF WE CHOOSE TO DO SO, AND/OR TO CONTINUE BILLING THE CARD IN ACCORDANCE WITH THE TERMS OF THIS AGREEMENT (WHETHER OR NOT WE HAVE OBTAINED A NEW EXPIRATION DATE). 

  7. OG Memberships

    What are the benefits of being an OG?

    As an OG, you’ll have the unique advantage of locking in your promotional membership price forever, as long as you maintain active membership, even if our pricing changes over time. Additionally, there are no cancellation fees if you decide to cancel your membership. Please note that OG memberships cannot be upgraded or downgraded to another OG offer. Any changes or cancellations will require adjusting to current membership pricing.

3. Use and Participation

  1. Respect. Oasis Fit is committed to each member’s health, safety, and welfare. Unreasonable, threatening, obscene, harassing, indecent, illegal, or any other disrespectful behavior is strictly prohibited (collectively, ‘disrespectful behavior’). Oasis Fit may, at its sole discretion, determine whether any member’s behavior or act meets its definition of ‘disrespectful behavior.’ 
  2. Equipment. All equipment must be used as designed and for its intended purpose. Any member unfamiliar with the use of equipment must arrange instruction with an Oasis Fit staff member. 
  3. Saunas. Please shower before using the sauna and observe the signage for maximum occupancy. Do not enter the sauna if the sauna is at capacity. 
  4. Mobile Devices. The use of cellular phones, laptops, or other mobile or recording devices is not allowed inside locker rooms, bathrooms, spa areas, or the Kids Club. You must use your mobile devices respectfully while at the Facility. Oasis Fit may deem your use of any mobile device ‘disrespectful behavior’ even if your use is outside a location referenced in this section. Upon our request, you will promptly remove any content from any social media site or other publication if the content includes any likeness of Oasis Fit, the Facility, any staff member, service provider, any member using the Facility, or a guest of Oasis Fit. 
  5. Attire. Proper athletic attire and footwear are required while using the Facility. Proper footwear includes athletic or court-style shoes. No open-toed shoes, thongs, sandals, street shoes, slipper-type shoes, or bare feet are allowed unless specified by an Oasis Fit instructor or other service provider. 
  6. Smoking, Food, and Drink. No smoking is allowed in the Facility. No food or drink is allowed in any area not designated for food or drink. Water may be taken into the Facility if it is in a non-breakable, enclosed container. 
  7. Weapons. You may not bring a firearm or any other weapon into the Facility, even if you have a permit to carry a weapon. 
  8. Service Animals. Service animals, as that term is defined by Fla. Stat. Ann. § 413.08(d), are permitted to accompany members with disabilities to any area of the Facility generally open to members. Oasis Fit may remove a service animal from the Facility if it is not housebroken, is out of control, or meets any of the other criteria described in Fla. Stat. Ann. § 413.08 (f) or other law permitting removal of a service animal. For the safety of our members, emotional support animals and pets are not permitted in the Facility. 

4. Personal Property

  1. Lockers. Lockers are available for day use only. Oasis Fit may remove  articles left overnight. 
  2. Valuables. You should NOT bring valuables into the Facility. Oasis Fit assumes no responsibility for lost or stolen articles. 
  3. Release. You hereby release Oasis Fit from liability for any loss or theft of personal property, whether caused by Oasis Fit’s negligence or otherwise, including, without limitation, loss or theft of personal property from lockers, the locker rooms, or elsewhere in the Facility. 

5. Services

  1. Appropriate Contact. Participation in any Service is voluntary. You acknowledge that the nature of these Services may require an Oasis Fit instructor, therapist, or another service provider to touch you or contact you in some manner.  If you have any concerns about how a Service was performed, please report your concerns to the Oasis Fit management. Oasis Fit requires its staff to uphold the highest professional standards, and we expect the same from our members. Oasis Fit considers sexually suggestive comments or other inappropriate behavior to be ‘disrespectful behavior’ as that term is defined in these Policies. In response, Oasis Fit will take any action it deems appropriate, including notifying law enforcement. Services are Provided by Oasis Fit.
  2. Oasis Fit Providers. No purchase of any Service is personal to any instructor, therapist, or other service provider. Instead, you hire Oasis Fit to perform the Services, and Oasis Fit will appoint a qualified service provider. However, Oasis Fit will make reasonable efforts to accommodate your request for gender-specific service providers. If Oasis Fit is unable to accommodate such a request, Oasis Fit will assist you in rescheduling or, if needed, canceling your Service.
  3. No Outside Trainers. You may only use service providers employed by or contracted by Oasis Fit. Outside trainers or other service providers may not do business of any kind in the Facility, whether in the form of client solicitation or training facilitation. Also, members may not provide one another any service at the Facility whether or not a fee is charged unless Oasis Fit consents to such activity, which consent Oasis Fit may withhold for any reason. 
  4. Cancellations. If you ARE REQUIRED to cancel your membership before the end of the term, a $100 fee is required and must be requested 30 days before your billing cycle, by sending an email to hello@oasisfit.com.

    OG memberships don’t have a cancellation fee.

    1. Credit Card. You authorize Oasis Fit to charge your credit card on file for any used or unpaid appointment/class or an appointment/class canceled or rescheduled 24 or fewer hours prior to your appointment/class. 
    2. Expiration. You must use your appointment for Services within six months of purchase. Oasis Fit is not required to honor or schedule an appointment/class made six months after the date you purchased the appointment/class.
    3. Refunds. All sales are final. No refund will be given for any unused Service.
  5. Declined Cards If our first attempt to collect your payment is unsuccessful, we may make additional attempts and a $25 service fee will be applied.
  6. Amenities Please be aware that within our membership and package offerings, the term “amenities” does not grant access to the weight room, except for Muscle and Active memberships.

6. Booking conditions

  1. book in the app and check-in when you come in

    Please ensure you always show your client ID inside the Oasis Fit app to check in and proceed to your class.

    You can also book through our website or by calling us directly.

  2. only one class per time This includes overlapping classes and waitlist bookings.

  3. bookings open 6 days before the start time of the gym visit or class. The scheduling window will start every day at 12 pm.
  4. CANCELLATION IS AVAILABLE UNTIL 6 HOURS BEFORE. Late cancellations will be classified as a no-show. If a spot becomes available in a class, it will be assigned to those on the wait list in order of confirmation.

  5. ARRIVE 10 MINUTES BEFORE.

    If you do not arrive at the studio in which the class is being held before the class start time, your place may be given away to those on the waiting list.

    If you are not present 5 minutes after the start time of the class or after the first song at cycling begins, your spot becomes automatically forfeited and that will be considered one strike in your ‘late show’.

  6. YOU CAN BOOK ONTO WAITLIST. If a spot becomes available, you will be sent an email or text message to say you have been placed into the class but can cancel/decline if you choose.

  7. 1 STRIKE CANCELLATION THEN CHARGE. Please note, if you accrue one (1) late cancel and/or NO-SHOW. You will be charged a no-show fee of $35 for the 2nd late cancellation and The receipt will take the form of an email. This policy maximizes the potential number of spots available to members.
  8. no reservation for other people Spots cannot be reserved for friends and/or family in any of the classes (Fitness, Zumba, Cycling, Pilates, Yoga, Hot Yoga) each client can reserve only their personal spot through our app.
  9. All of Oasis Fit ‘The Experience‘ members can book one (1) pilates class per day and up to 20 classes per month (no rollover). For those interested in taking additional classes beyond the allotted limit, we are pleased to offer a special preferential price of $45 per class or buy pilates packages.

7. Children

  1. Age. Children younger than 15 years (“child” or “children”) are not permitted entry unless they are joining Oasis Fit Kid’s Club or a similar program. 
  2. Release Required. If you bring a child to the Facility, you must sign a release form on behalf of your child before your child may enter the Facility or participate in any program, including Kids Club. 
  3. Supervision. You must supervise your children. This policy applies any time you are occupying the Facility unless your child is participating in a children’s program authorized by Oasis Fit. Oasis Fit is not a daycare. You are strictly prohibited from leaving the Facility while your child is in the Facility. We reserve the right to refuse any disruptive or ill child from participating in any children’s programming, including Kids Club. 

8. Guests.

Guests may enter and use the Facility on payment of a fee determined by Oasis Fit from time to time. Guests must sign the register upon entry and show a form of photo identification. The number of visits given to a guest is at the sole discretion of Oasis Fit. The guest must be at least 15 years old. 

9. Freeze Policy.

  1. Procedure. Subject to the eligibility requirements below, you may put your membership on a temporary pause (a “freeze”) by notifying Oasis Fit in person at least fifteen days before the intended start of the freeze or by emailing Oasis Fit at least 15 days before the intended start of your freeze. 
  2. Period. You are allowed [one (1)] freeze per six-month term and may freeze your membership for up to one (1) month. Freezing your account at any time for less than (1) month will not enlarge this limit.   
  1. Eligibility. You are eligible to request a freeze under this section if:
  1. YOUR MEMBERSHIP IS IN GOOD STANDING (YOU DO NOT HAVE A PAST-DUE ACCOUNT OR AN OVERDUE BALANCE ON YOUR ACCOUNt.
  2.  YOU HAVE BEEN A MEMBER FOR AT LEAST THIRTY (30) DAYS.
  3. YOUR MEMBERSHIP IS NOT FOR A TERM LESS THAN SIX (6) MONTHS OR SUBSIDIZED BY A CORPORATE MEMBERSHIP PROGRAM
  4. YOU ARE MEDICALLY UNABLE TO USE THE FACILITY. IF YOU ARE MEDICALLY UNABLE TO USE THE FACILITY, OASIS FIT MAY REQUIRE YOU TO PROVIDE A SIGNED LETTER FROM YOUR HEALTHCARE PROVIDER ATTESTING TO YOUR MEDICAL INABILITY TO USE THE FACILITY. 

10. Other

  1. Interpretation. These Policies are intended to be read with and complement your Membership Agreement. The strictest interpretation will apply to the extent of any inconsistency between these Policies and your Membership Agreement. 
  2. Policies Amendments. Oasis Fit reserves the right to add to, change or remove rules, conditions of membership, opening and closing hours, and the Services and Facility and otherwise amend these Policies from time to time.
